US Dep't of ED & SUNY agreement to continue ignoring or retaliating against reports of sexual harassment & sexual assault

"Careful investigation": BS.

"to Chancellor Nancy Zimpher's great credit, SUNY has responded proactively": BS. The head of the SUNY-wide judicial administrators group Clarence L. McNeill was sending threats to me and my family while the SUNY-wide investigation was under way, while the complaint I'd made about UAlbany was under way, threats that have never been retracted even after the creation of the so-called "agreement" (an agreement that excluded meaningful - if any - participation by victims, their families, witnesses, etc.)

SUNY "voluntarily agreed": perhaps, provided they would be permitted not to admit their guilt - which indeed they refused to do.

"Student and staff safety" is referred to, but nothing about faculty (unless that comes under "staff") or visitor safety?

"Self evaluation and review": it's already known that SUNY doesn't do that honestly, so why let them continue to perform dishonest self evaluation and review?

I've yet to be contacted by the U.S. Department of Education or SUNY about their BS agreement. Whether anybody else has been contacted by them as yet about it - I doubt it. Nancy Zimpher and Arne "Basketball" Duncan should be doing life sentences in federal prison right now. They're too rich and powerful and have too many rich and powerful friends to ever be held accountable for their crimes, however.

I received this e-mail at 11 p.m., 6 hours after I sent my reply.

Thanks for your November 2nd reply to my October 12th; what prompted it?

Clarence L. McNeill's e-mail and attachment of August 3, 2012, which he subsequently sent to my home address postmarked August 7, 2012, arriving August 8, 2012 forbade me to communicate with anyone other than himself at UAlbany, via any means, for any purpose, for the rest of my life. As such, I cannot cc Mr. Reilly and Ms. Thayer as you had; however, since Mr. McNeill had cc'd them on his August 3, 2012 e-mail, they should already know that I can't include them on my reply to you.

It's just as well in the case of Mr. Reilly and Ms. Thayer, however, that there is such a prohibition; I'd just as soon never be contacted by them and never have any reason for me to contact them. Mr. Reilly never answered my e-mail of July 19, 2012 11:41:50 AM (sent prior to Mr. McNeill's prohibition, obviously). It might have helped matters some if he had replied at that time; the size of the problems at UAlbany at this point may owe a lot to him.

Mr. Reilly had also been cc'd by UAlbany's Records Access Officer Lisa A. Taylor on her June 4, 2012, 10:08 AM reply to my e-mail of June 4, 2012 9:42 AM. She hadn't explained why she'd added Mr. Reilly. I'd questioned why it was potentially going to take until July 2012 for me to obtain my grades for a Fall 2011 course that had ended in December 2011, and somehow that was sufficient reason for her to cc UAlbany's Senior Counsel. Incidentally, for some reason Mr. Reilly's still only identified as Associate Counsel at http://www.albany.edu/legal_counsel/

December 2011 to June 2012 seems a rather long time to wait for grades. I'd finished all courses in December, and graduated in May (due to an incomplete finished in December, but too late to graduate).

"Examinations and other assignments submitted for grading during the term should be returned with sufficient promptness to enhance the learning experience."

[I continued reporting a host of other problems regarding her putting people I'd reported in charge of investigating their own crimes, non-compliance, etc. You'd think she'd have been grateful, as it saved her the trouble of rooting out the non-compliance herself, but even now seemingly nothing's been done.]

Why Ms. Ellermann and Ms. Abbruzzese-Werling continued including me in the "to:" lines of their e-mail exchange, I'm not sure. Perhaps they're simply just that bold in their disregard for the rule of law and constitutional rights, or perhaps they're both monumentally stupid, ignorant people (or all of that might be true). It would seem fairly obvious that a necessary part of any agreement between the U.S. Department of Education and SUNY would involve Ms. Ellermann and Ms. Abbruzzese-Werling doing life in prison...at minimum.
