Sojourner-Douglass College accreditation revoked; UAlbany "Chief" Wiley's degree from there

The college from which UAlbany “Police Chief” J. “Frank” Wiley allegedly received a bachelor of arts degree in Human and Social Resources (which has a concentration in Criminal Justice as an option) lost its accreditation this year.
Students at the Inner Harbor East Academy will relocate to a temporary facility next week because the school’s operator, Sojourner-Douglass College, hasn't paid the heating bill, according to city school officials.

Sojourner-Douglass College is being sued by the owner of its Edgewater campus property for failure to pay rent, according to school officials and the plaintiff's attorney.

The lawsuit, filed last month in Anne Arundel County District Court, is the latest in a series of setbacks for the Baltimore-based school, which has satellite campuses in Maryland and in the Bahamas.

the school faced financial difficulties — including a $5 million lien from the Internal Revenue Service. The Middle States Commission on Higher Education cited the financial woes when it moved last year to revoke accreditation and again this year when the college appealed.

The college sued the commission the day before the accreditation was revoked, claiming racial discrimination, breach of contract, violation of due process and negligence.

In addition to denying the request for an injunction, Hollander dismissed two counts in the lawsuit — racial discrimination and breach of contract. She gave the college 17 days to revise the lawsuit.

The college’s website http://www.sdc.edu doesn’t appear to give any indication that its accreditation was revoked, or that they revised their lawsuit within the seventeen days they were provided.

The Human Services degree with a concentration in Criminal Justice in recent years may not be exactly the same as Wiley’s Human and Social Resources degree from 1989, but one would suppose it to be at least similar. There's only about eighteen credits' worth of courses that seem relevant to criminal justice:

They did have a Criminal Justice degree also, but I'm not sure if that was available when Wiley was there.

Its curriculum in its early days sounds unusual: "the S-D administration builds its very curriculums around the experiences of the students. Dialogue between the professors and their students becomes critical. The students bring their experiences to the classroom, and blend books and theory to come up with a workable whole." For many things that might be ideal, but for police procedure or police administration, I'm not so sure. The enrollment was said to be 350 students at that time.

In 1990, a year after Wiley allegedly graduated, there were rumors the college would close (due to problems that had apparently existed while Wiley had been a student). The federal "Office of Education had threatened to terminate all of its federally backed student financial aid programs […] audits performed in 1987 and after, indicated that the Guaranteed Student Loans (GSL) and other programs were awarded before the college thoroughly investigated backgrounds of those applying for assistance and resulted in a high default rate for repayments. Further inquiries found that Sojourner-Douglass had not disseminated federal monies awarded to recipients by the mandated deadline and improperly filed student records needed to conduct required bi-annual audits. […] 'Sojourner-Douglass had a 40 percent default rate which is considered high'"

Questionable financials for about thirty years! Have people involved with the college been audited?

Supposedly Wiley graduated summa cum laude. I'd be curious to know if everybody who graduated there graduated summa cum laude....

With the NYS Division of Criminal Justice Services having written in response to a FOIL request that Mr. Wiley “has not completed any training, including basic training, reported to DCJS" and with the NYS Department of State Assistant Records Access Officer having written in response to a FOIL request that they could find no Oath of Office on file for Mr. Wiley for 1996 or 1999 when SUNY peace officers became full police officers, and his dodgy degree, one really has to wonder how he continues to be employed there - and to be one of the highest-paid chiefs in SUNY and in the Albany area for that matter. His love for football, his having been an athlete, his having been a coach, his creating a ride-along program for football players, his police getting paid extra to do security for the NY Giants' summer training camp at UAlbany when it was there, his decision not to report a gang rape by UAlbany football players to the Albany County DA's office ASAP, etc. all likely answer the question, though.

In 1996 when he was hired, SUNY Albany had a need for a police chief who would lead the department to solving the disappearance of SUNY Albany student Karen Wilson and who would be able to handle a campus shooting case like the then-recent one of Ralph Tortorici. Instead, not long after Wiley was hired Suzanne Lyall went missing under circumstances somewhat similar to Karen Wilson's - something that should not have happened if the Wilson case had been given proper attention. Had Wiley ever worked a missing persons case as an officer while in Maryland, much less led one as a chief? I doubt it!

Wiley's signed off on false Clery Act reports for years. He's willing to back threats made against a student who dares to report crimes. The man belongs in prison.

preventing campus shootings

Aran Mull, Deputy Chief of the UAlbany Police Department, said that campus shootings have a “profound impact on community and national psyche,” which is why prevention is key.

UPD is credited with creating the first New York State Division of Criminal Justice certified active shooter response training course.

When UAlbany Police have undermined the integrity of firearms audits, one has to wonder how effective UAlbany active shooter response training might be.

When UAlbany Police have testified for court that they're inadequately trained, once again one has to wonder.

"In a sworn statement given to State Police on May 19, a fellow SUNY investigator, Matthew A. Griffin, said that Knoebel had called him on May 17 and asked him to remove two pistols from her locker at the UAlbany police headquarters.

"He said Knoebel was comfortable storing her departmental weapon in a police armory safe but she asked him to take another gun, a .25-caliber Ravens Arms pistol, to his private residence for safekeeping.

"Griffin said he did not know at the time that Knoebel was facing imminent arrest on federal drug charges. He told State Police that he only learned of those charges the following day, May 18, after he had already returned Knoebel's unregistered handgun to the police station and logged it in as evidence. [...]

Griffin, 39, has been with SUNY police since March 1997 and was promoted to investigator in 2003. He said Knoebel told him in April that she was considering filing for divorce from her husband, Kenneth, who also was arrested on marijuana charges. Griffin said at that time he advised her to bring any guns she had at home to the police station for safekeeping because a divorce could trigger "emotional" reactions.

In that May 2011 incident, two UAlbany officers committed serious violations of firearms policies. Griffin, in particular, was grossly irresponsible in advising Knoebel - who he believed to be potentially emotionally unstable - to bring all of her personal firearms onto campus. And why did UAlbany Police apparently not notify the system administration office of university police about the incident (a FOIL request for the notification turned up nothing)?

Griffin, a man who clearly lacked the most basic common sense with respect to firearms, was UAlbany's "Chief Firearms Instructor"! Among other things I wonder: do UAlbany Police continue to illegally store unregistered junk guns in their lockers on campus?

"A University at Albany student was assaulted on campus by two men, one of whom appeared to have a handgun. [...] The victim knew the assailants, who are not UAlbany students. Police said no shots were fired and that the assailants fled in a red Honda Civic. [...] University police said there was no danger to UAlbany community and that police agencies have been notified to look out for the Honda."

If the identity of the men was known, why not identify them; if the red Honda Civic was not a stolen one, why not list the year and license plate number; if they were presumed armed, why were they not considered a danger to the community? If it was that the men were presumed innocent until proven guilty, then why run the article at all; why note that the red Honda Civic was something people were trying to locate?

It's not hard to learn what the school policies are about weapons on campus. There's a multitude of rules, all saying more or less the same thing: it's not allowed.
"The rules of the State University Board of Trustees (8 NYCRR §535.3 (j)) prohibit the possession of air guns, firearms, rifles, shotguns or other weapons on a state-operated campus of the University without the written authorization of the campus president."

"No air gun, firearm, rifle, shotgun or weapon may be possessed, stored, discharged, loaded or used on property owned or leased by the University unless the person in possession of said device meets the requirements set forth in these administrative procedures. The president of each state-operated campus may, in accordance with the provisions of section 590.3 of the rules of the University Board of Trustees (8 NYCRR § 590.3), grant written authorization to students, faculty, staff or other persons to permit the possession and storage of air guns, firearms, rifles, shotguns and weapons on campus only where such possession is required or permitted for the purposes specified in said section. When authorized, they will be stored unloaded in an appropriately secured area within or under the control of the University police department of each state-operated campus."

One of the best ways to make UAlbany safer might be to replace UAlbany Police and other officials and administrators with better men and women!

On the topic of preventing UAlbany shootings... fraternities at UAlbany are at least as dangerous as UAlbany Police and UAlbany athletics. The student who drank about 60 ounces of vodka in a hazing incident, died from approximately 40 shots to the head (supposing them 1.5 each, a fairly standard shot glass size). A healthy number of shots for someone who is of age, not an alcoholic, etc. is just two shots.

How many hazing deaths have there been at UAlbany? It's difficult to say. There was a particularly nasty case involving a wide receiver on the SUNY Albany football team stripping to his underwear and entering the cold, murky, polluted body of runoff water filled with metal debris called "Indian Pond" wherein he was ">electrocuted to death in front of twelve other pledges and ten fraternity brothers. Because it supposedly did not involve coercion, it wasn't held to be hazing. You know, because guys are always eager to strip to their underwear in front of a bunch of other guys in public and enter a cold, murky, polluted body of runoff water filled with metal debris....

Questions about how the pond had become electrified and why the university hadn't done anything about it being electrified after having been warned by a student about it seem to have gone unresolved, as questions about deaths at UAlbany often seem to do.

It doesn't help matters that the campus judicial administrator at UAlbany, Clarence McNeill, had been a member of a fraternity at UAlbany. Not necessarily damning in and of itself (there are good fraternities), but McNeill's a nasty piece of work as this blog has repeatedly indicated. Also, consider how some of the usual suspects at UAlbany have handled hazing and drinking in the past:

Photographs suggesting hazing and underage drinking by members of the University at Albany women’s lacrosse team have surfaced on the Internet, the second time in two weeks a local college team is facing questions about the off-the-field behavior of its athletes. […] However, all of the images had been removed by 3 p.m. Wednesday, after Times Union reporters started contacting team members for comment.

Photographs documenting athletic team hazing at UAlbany disappeared (*poof*) after the Albany Times Union, which regularly covers UAlbany sports and which is published by the President of the Board of Directors of the UAlbany Foundation and which is (or historically has been) available free of charge on campus, started contacting team members… fancy that.
There is no evidence to support hazing allegations against the University at Albany women’s lacrosse team, the school announced Wednesday after a three-week investigation prompted by photographs posted on the Internet. […]

The investigation was run by university counsel John Reilly and associate vice president for student success John Murphy, who interviewed women's lacrosse head coach Lindsey Hart and assorted players. University police chief Frank Wiley assisted the inquiry.

Three men employed by UAlbany interview a group of women students, and reportedly none of the women report hazing. Not exactly surprising.

Did the three men interview the women individually - which could be intimidating and inappropriate - or did the three men interview the team of women all at once, in which case there might be strong peer pressure not to say anything? And if any women did say anything, might not they have been threatened by Reilly, Murphy, and/or Wiley not to speak up about it again, considering the type of men Reilly, Murphy, and Wiley are?

With respect to last year's hazing death:

UAlbany sent NEWS10 ABC a list of hazing prevention tips but declined a request for an interview. The school said “We don’t want to get involved.”

State Government "Accountability" & the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act

The above 2014 Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act compliance audit does not appear to have addressed the issues brought to the NYS Office of the State Comptroller’s attention in an e-mail which OSC acknowledged (see below October 2012 e-mails). One of the serious issues: the State University of New York at Albany had not been properly maintaining its sexual offender registry for years.

Obviously two sexual offender registries should not have been online at the same time, listing different people, both of them with obvious basic mathematical issues (e.g. three does not equal 4 and does not equal six), and both obviously years out of date. On a campus where there are two unsolved disappearances of female students, Karen Wilson and Suzanne Lyall, that is appalling. Are such issues consistent with the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act or the Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act?

The registry I think now may have html code that automatically updates the year on bottom of the page http://police.albany.edu/SOR2.shtml “© 2015 University at Albany” regardless of whether the registry has actually been updated. The simple suggestion to various parties of an explicit statement on the registry regarding when it was last updated and by whom was not implemented.

It all does raise some concerns…

Unfortunately, it’s hard finding someone in a position to do something about it who also would see the need to do something about it. SUNY Chancellor Nancy Zimpher and SUNY Police Commissioner Paul Berger (who had been a member of the command staff of the UAlbany Police while the UAlbany Police were failing to maintain their sexual offender registry) seem to prefer that campuses not be secure, that students, faculty, staff, and visitors to campuses not be safe. One hopes better people will be appointed someday!

Albany County Comptroller Mike Conners wrote me on September 27, 2012 5:36:37 AM that he'd forwarded an e-mail of mine (it is included below) to the NYS Comptroller, but I have not heard back from the NYS Comptroller's Office at all. I had tried sending it to the Comptroller's Office myself originally, but perhaps the e-mail address is not one that is working.

I reported it to the Office of Sex Offender Management / Sex Offender Registry at infodcjs@dcjs.ny.gov but they did not respond. The Albany County Sheriff's Office indicated it's not their jurisdiction, if I understood them. The Albany County Comptroller wrote it's not within his purview. The City of Albany Police haven't responded.

I'm not quite sure of the relevant offices, so I'm e-mailing several offices that seem relevant. DCJS because of the sex offenders, NYS Comptroller because of past Clery Act violation investigations, Albany County Comptroller as seemingly relevant jurisdiction.

There's a couple of seemingly-Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act-related issues I wished to raise: (1) contradictory and possibly outdated information regarding sex offenders at the University at Albany and (2) contradictory information regarding who the Campus Security Authorities at the University at Albany are for the purposes of the Clery Act.

1) University at Albany Sexual Offender Registry

"There are currently three (4) registered sex offenders enrolled or working at the University. The following Information has been released:"

Following the colon on that page are not three (3), or four (4), but six (6) registered sex offenders.

2) University at Albany Campus Security Authorities for the purposes of the Clery Act

The Annual Safety Report/Clery Act Report http://police.albany.edu/ASR.shtml on page 58 states "The DCJS Sex Offender Registry site may be found on the web (See the link to the right)". Since there's no link to the right within the PDF that I can see, it seems to be cut and paste from elsewhere, perhaps from the website. Possibly more care should be taken in writing the Clery Act Report, since the NYS Comptroller has after all found that UAlbany has had a number of Clery Act violations in the past.

Another issue regarding problems in relation to the Clery Act: page 21 of that report and also http://police.albany.edu/CSA.shtml (c) 2009 identify the Campus Security Authorities under the Clery Act as:

• Professional staff in Student Success except Student Health Center and Counseling Center staff

Which of the three different lists of Campus Security Authorities is the correct one?

It's not clear to me why the Vice Provost for Undergraduate Education (who is also the Dean for Undergraduate Education) would be a CSA while the Dean for Graduate Studies does not appear to be a CSA.

It would be nice if the previous annual reports were available online as well?

Hearst's dirty cop Paul Berger appointed SUNY-wide Police Commissioner

A retirement ceremony for Bruce McBride, commissioner of the State University of New York Campus Police, was held Wednesday at the SUNY Plaza.

Paul Berger will replace McBride as head of campus police for SUNY.

Naturally, the Times Union did not mention that Paul Berger had been a SUNY Albany police officer, or that the SUNY Albany Police had been paid extra to do security for the NY Giants summer football training camp that the Times Union helped lure to and kept at SUNY Albany (while the Times Union published a defense of hazing by the NY Giants), or that the Times Union publisher George Randolph Hearst III is the President of the Board of Directors of the University at Albany Foundation. The Times Union isn't exactly known for being scrupulous about their potential (or actual) conflicts of interest.
Because the Times Union covers the University at Albany, its sports programs and the Giants summer camp, there's a possibility for conflict of interest […] "We simply talk about this a lot and do our darndest to prevent it"

While at SUNY Albany, Berger failed to solve the disappearances of Karen Wilson and Suzanne Lyall. (Wilson disappeared in 1985; Berger joined the SUNY Albany Police in 1988.) With Berger now as SUNY Police Commissioner, imagine how many more disappearances there will be that he'll fail to solve! With the shining example of incompetence and corruption that is Paul Berger, think of how many more incompetent and corrupt SUNY Police officers the public has to look forward to for years to come!

It makes one quite ill. The public deserves better than this. Victims deserve better than this.

The man who established the charity that on Wednesday was revealed to have donated $25 million to Albany Medical Center, William Duker, was a high-flying Manhattan attorney before being convicted for defrauding the federal government in the late 1990s. Duker then resurfaced in the Capital Region about a decade ago as a successful venture capitalist. [...]

No information about William Duker's current professional activities was released by Albany Med Wednesday. Neither Albany Med nor Duker responded to requests for comment.

No financial information could be found for the Bernard and Millie Foundation. A filing for the Bernard and Millie Children's Foundation, which includes Duker, his wife, Sharon, and son, West, as directors, listed its assets as just under $31,000 at the end of 2012. [...]

Duker reportedly earned millions as a Manhattan attorney in the 1990s. He was part of the legal team hired by the federal government to seek damages from junk-bond king Michael Milken, according to previous Times Union reporting. Duker was later charged with defrauding the government by inflating his bills by $1.4 million. In 1997, he pleaded guilty and was disbarred. He served 16 months of a 33-month sentence that was handed down by then-federal Judge Sonia Sotomayor (now a U.S. Supreme Court justice).

Judge Sotomayor claimed to struggle with his sentence at the time, given the benefits of his work to the government, according to a story in the New York Times. But she was swayed by the gravity of his offense and Duker's attempts to cover up his crime, the newspaper reported.

Former UAlbany football coach Bob Ford after whom UAlbany's football field is named (also mentioned in the above article), had been an acolyte of Joe Paterno and continued to worship Joe Paterno even after Paterno's support of sexual assault and pedophila became more publicly recognized.

A Moment of Silence for the Umpqua Community College Victims - and the victims of SUNY Chancellor Nancy Zimpher

The family of Alexandra Kogut is considering whether to sue New York state and The College at Brockport for failing to provide enough security that might have prevented the freshman’s death, according to court records.

A notice of claim filed two months after 18-year-old Kogut was beaten to death on Sept. 29, 2012, inside her dorm room by her boyfriend, Clayton Whittemore, alleges that “campus police/security fell below the standard of ordinary care” expected of an entity that legally takes on some of the responsibilities of a parent.

Actual definition of a cease and desist order suggests it is something that cannot be issued by a single individual, or outside of a trial of some kind. USED knew no trial to have occurred when they posed their leading question, and did not (could not?) point to any part of the Code of Conduct that grants Clarence McNeill to issue cease and desist orders at all - much less to victims or witnesses.

Old news, but worth reviving. Stupid judges back stupid (or shrewd?) politicians who want stupid cops. If the dubious Wunderlic test is used by SUNY (as it has been by the National Football League, whose judgment is less than impeccable) then SUNY cops, presumably, are required to test even lower than real police? I wonder if "Chief" Wiley could have ever managed to score higher than 3 out of 50 without cheating?

Apparently if any smart person wants to become a police officer, he or she would have to intentionally get a certain number of questions wrong. A test so easily gamed is that much more dubious for that reason.

Altarriba, among other things, permitted the middle-aged white male American Barberich to joke about torturing a young female Asian foreign national teaching assistant. Psychologist Altarriba's down with joking about torture - as apparently is the APA (who after all were complicit in torture). The APA announced Altarriba would be getting an award "for her outstanding contributions to teaching and training ethnic minority psychologists." "One of the most rewarding parts of my career has been to stimulate and motivate students of color to achieve their goals, to overcome any obstacles that they have experienced or are currently experiencing, and to move forward towards a life that is meaningful and fulfilling, both personally and professionally," Altarriba lied. Apparently that "stimulation" of students of color by Altarriba also involved letting the white Barberich joke about hooking up a student of color to electrodes and shocking her until she screams... but how is that meaningful or fulfilling?

Barberich noted to Altarriba that I'd also reported her unethical behavior, after which she falsely accused me of inappropriate use of technology, and she libeled me to members of the department, claiming I'd been sent a cease and desist order and that I'd violated it twice when in fact I'd never been sent a cease and desist order at all. Her unethical and criminal behavior in the service of Barberich's perversions and crimes might be what earned her the promotion to Vice Provost and Dean for Undergraduate Education, so she could help UAlbany become even better for sociopathic employees and much, much worse for anyone actually seeking an education or hoping to avoid being sexually assaulted on campus by sociopathic employees. If that's not deserving of an award, what is? O.o

UAlbany's Police "Chief" J. "Frank" Wiley tells the truth for once!

Given Wiley's lack of education, lack of training, lack of experience, lack of intelligence, lack of ethics, etc. it's pretty much a given the way he and his underlings do policing is fundamentally ineffective. Kudos to Wiley for the admission. Wiley, being Wiley, then went on to lie his ass off, naturally.

[Wiley's] suggestions were to create a concrete code of “officer behavior” and a policy to enforce this code, to allow for system complaints, to increase transparency, to conduct climate surveys, and to incorporate direct observations through the use of body cameras. He also talked about involving the community through advisory groups that specifically target the youth, as well as academics (so that research can be put to practical use). Finally, Wiley proposed a new way of looking at policing: he said that the focus should be on “advocacy and support” rather than enforcement.

Wiley supports a kind of policing known as “community policing” and he referred to the “Peelian Principles,” which are a set of nine principles created by Sir Robert Peel, meant to be guidelines for what an ethical police unit should do and be. Wiley said that at UPD, officers must use at least one principle in every decision they make. He suggested to the crowd that they learn the principles and ask that their police force use them.

There are some concrete codes of officer behavior and a policy to enforce it: the SUNY Police Manual and the UAlbany Police Manual. Both are poor, but they are in writing - yet they're not enforced in part due to Wiley's idiocy and corruption. Wiley doesn't believe in transparency, and if they were to use body cameras they would inevitably in some cases "lose" the video they take. It certainly figures that Wiley thinks that law enforcement officers should cease focusing on law enforcement: he's a lawless man.

The "Peelian Principles" are a bit of BS the UAlbany Police regularly use to pad out their annual reports, accompanied by false statements about how the UAlbany Police allegedly abide by those principles. In reality, the UAlbany Police do not use those principles.

Our philosophy, strategies and tactics are, and have always been informed by Sir Robert Peel, the father of policing. Among his standards for effective policing are:

1. THE ABSENCE OF DISORDER ‐

Emphasis on prevention through high presence and robust educational programming;

Restrained use of force with no personnel complaints for 2012 alleging the improper use of force.

2. RESPONSIVENESS TO COMMUNITY CONCERNS ‐

100% of all crimes are followed up;

99% of calls for service were responded to within four minutes or less.

3. POLICE ACTIVITY ‐

University at Albany Police Department cleared 50.3% of its crime cases; the national average is 20%.

4. IMPARTIAL SERVICE OF THE LAW ‐

There were no allegations of biased policing;

Three personnel complaints were filed. They were investigated and determined to be unfounded;

All gender, racial, and ethnic demographics are published, as we believe impartial service is best demonstrated through absolute transparency.

UAlbany Police do not have a "high presence" on campus (what they do all day other than attend athletic events for their own enjoyment, I don't know) nor do they engage in "robust educational programming." "100% of all crimes are followed up": BS. The only way that's true is by virtue of "followed up" being so vague; throwing a report of a crime into a trashcan could constitute "following up." "No personnel complaints": BS. Many people don't feel it would be safe to make them; when they are made the UAlbany Police will ignore them, or they'll be "investigated and determined unfounded." The UAlbany Police and the SUNY Police do not have internal affairs bureaus, so one can imagine how often complaints are actually taken and genuinely investigated.

UAlbany's clearing of its crime cases is one of the more outrageous lies. There's no way in hell they really clear 50% of crime cases: they might get there by refusing to take reports about crimes, by declaring cases to be unfounded without properly investigating them, and other methods that amount to facilitation of crime.

Yellow Journalist Hearst's Times Useless reports on Heart's own dirty cops

There's a nice above-the-fold cover story by the Albany Times Union about the dirty cops George Randolph Hearst III bought, the UAlbany Police. Dirty cop Aran Mull in particular gets a lot of press, and a couple photos. Naturally no mention is made of the Times Useless' publisher Hearst also being the President of the Board of Directors of the University at Albany Foundation. Naturally no mention is made of the Times Useless having paid UAlbany cops extra to do security for the NY Giants' summer training camp at UAlbany that the TU helped lure there, work that took them away from protecting students, faculty, and staff - i.e. work that took them away from their actual jobs.

These are the same cops who supposedly didn't know their own decorated co-worker Investigator Wendy Knoebel had a major area drug operation at her own home. For all the public knows, Knoebel was growing drugs for her coworkers - the TU never reported where marijuana from her 200 or so plants was going that I ever saw. This is at a campus where deaths by overdose are disturbingly commonplace.

Mention is made of the discretion police supposedly have not to make arrests when crimes have been committed. Is that alleged discretion genuinely written into law? When referrals are made of drug users, drug dealers, or drug manufacturers, is the law really being followed? Who gets referred (athletes and donors' kids, maybe?) and who gets arrested? If referrals are made to "judicial administrator" Clarence Loser McNeill, a skinhead with a vicious love of sexual assault and other crimes, what purpose does that serve?

SUNY Albany might not be complying with the Clery Act with respect to “Clery Geography” in its reports. I’ve contacted the Clery Center for Security on Campus separately with substantially the same as much of what follows.

I suspect what Clarence L. McNeill wrote below might be in part technically true if the University at Albany Foundation owns the East Campus property rather than the University at Albany itself owning it. However, when it’s been repeatedly claimed, for example, that SUNY or SUNY campus Foundations aren’t subject to FOIL, they’ve been repeatedly informed by the NYS Department of State Committee on Open Government that they’re wrong about that (see e.g. http://docs.dos.ny.gov/coog/otext/3398.htm http://docs.dos.ny.gov/coog/otext/o4130.htm http://docs.dos.ny.gov/coog/ftext/f17411.html etc.). If the claim that the properties are not owned by the state is being used to justify the lack of a law enforcement agreement or Memorandum of Understanding (MOU) regarding those properties or to justify the lack of SUNY Police presence at those properties, that might be similarly problematic:

Page 11 of 120 includes the East Campus as part of the Clery Geography, though it is a campus Clarence L. McNeill claims “State of New York, on behalf of SUNY and the University at Albany, does not own” and is a place where Clarence L. McNeill claims “the University at Albany does not have University Police stationed”. One wonders why it is included in the Clery Act report while several other properties don’t appear to be included.

If the University at Albany Foundation owns the main and downtown campuses in Albany, then by Clarence L. McNeill’s reasoning (if that’s his reasoning) there should not be University Police on the main and downtown campuses either. I don’t know who owns those campuses.

So-called judicial administrators with no degrees in law really shouldn’t be allowed to respond to FOIL requests, particularly when the law does not appear to provide any provision for them to do so. Not that I have such a degree, and I could be mistaken on some of the points herein; I’ve only made an amateur study of some narrow points of law - which appears to be one iota more than Clarence L. McNeill has ever done.

One wonders, regardless, whether any police patrol the East Campus, Smart System Technology & Commercialization Center, Dippikill Wilderness Retreat, etc. and if the local police in those areas realize that UAlbany doesn’t. That’s part of why agreements or Memorandums of Understanding (MOUs) would be desirable if not mandatory, I think! If the UAlbany Police can form a MOU with the UAlbany Football team:

UAlbany’s Clery Act Compliance Officer is John Murphy. He’d been signing off on the Clery Act reports despite UAlbany’s sexual offender registry having been obviously erroneous and out-of-date for years - so badly mismanaged, in fact, that UAlbany had two separate ones: one dated 2009 and one with no date, but circa 2007-2008. It’s hard to see how UAlbany will ever be compliant with the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act as well as the Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act as long as the people responsible for such outrageous failures remain employed there.

For anyone who can count to two without making an error, those are some pretty glaringly obvious problems on each individual registry - aside from the glaringly obvious problem that there shouldn’t have been two different ones online at the same time.

There was an audit by the NYS Comptroller’s Office in 2007 with a follow-up in 2009 http://osc.state.ny.us/audits/allaudits/093009/07s121.htm which found a number of problems, but it evidently failed to take note of the mismanagement of the sexual offender registry. The Registry gets referenced in the Clery Act Report https://web.archive.org/web/20130217082407/http://police.albany.edu/ASR.pdf on page 53 of the 2011 report, the claim being there that it was being maintained - when clearly (the above archives) it was not being maintained properly. I remain terribly sorry I didn’t finish a degree at some one of the other SUNY campuses where I’d been accepted years ago. In fairness to SUNY Albany: there are many good students, faculty, and staff there. For that matter, many members of my family have had strong ties to SUNY. It is in part due to such facts that I care so much about the horrible problems that are being permitted to persist at SUNY. The inexcusable, obvious problems with the sexual offender registry seem to have been addressed in large part, if not solely, due to my repeatedly reporting them at the local, county, state, and federal level over a course of several months. The salaries of the sixty or so members of the SUNY Albany Police along with the department’s budget evidently don’t cover such basic responsibilities as properly maintaining a sexual offender registry? In an effort to broaden the scope of the University Police Department’s (UPD) community policing initiatives, the Great Dane Ride Along Program has been created. The concept was put into action by UPD Chief J. Frank Wiley and head football coach Bob Ford. The Program will bring together officers of UPD and members of the University’s football team. The players will ride on regular patrol with the officers in two hour shifts.

“The program will expose the students to some of the problems University Police Officers face every day and at the same time will expose the officers to some of our student-athletes,” Ford said. “This is one of those things that only good can come from.”

According to Wiley, both the players and the officers are excited about this opportunity and so far, approximately 60 players have volunteered to participate in the program. He added that special planning will be used to ensure that the program will not interfere with the players’ academic schedules. University Police officers assigned to Quad Liaison duties will coordinate the department’s efforts. The program took effect after spring break.

Malcolm X’s Autobiography as told to Alex Haley (the author of Roots) is fascinating and I think his assassination was particularly unfortunate given that Malcolm X had by then left the racist Nation of Islam (thought by many to be the people who shot him) and was beginning to reach out to people of all races, but even still: a picture of him is a very odd thing to see in a police station! Malcolm X didn’t generally have much good to say about the police.

Barberich to harass minority students to his diseased heart's content by backing threats against those who would report his harassment, for instance). Malcolm X would have despised J. "Frank" Wiley.

SUNY Albany student evidently graduated from steroid trafficking to conspiracy to commit insider trading?

ALBANY — A 20-year-old University at Albany student who police said had devised an elaborate scheme to get steroids shipped to him was arrested Friday.

The Albany County Sheriff’s Department Drug Interdiction unit, which made the arrest with U.S. postal inspectors, said Matthew J. Musante might have been distributing steroids to several area fitness centers.

They said the investigation is continuing and would not say which fitness centers might have been involved. […]

With each search warrant, large quantities of steroids were seized, including 130 bottles of steroids containing 2,684 pills, 53 vials of liquid steroids and two tubes of cream. Authorities did not have an estimated street value for the steroids.
